We will only use your e-mail address to process your request. Your data will then be deleted unless you have consented to further processing and use.  


For the purpose of contract processing, all data required for the execution of a contract with buyhappy GmbH will be processed. If external vendors and service providers are also involved in the processing of the contract, your data will be passed on to them to the extent necessary in each case.  


When you access the buyhappy GmbH website/application, various information is exchanged between your terminal device and our server. This may also include personal data. The information collected is used, among other things, to optimize our website or to display content and advertising in the browser of your end device.  


When opening a customer account, we collect your personal data to the extent specified there. The data processing serves the purpose of improving your shopping experience with us and simplifying order processing. The processing is based on Art. 6 (1) DSGVO with your consent. You can revoke your consent at any time by notifying us, without affecting the legality of the processing carried out on the basis of consent until revocation. Your customer account will then be deleted. 


2. Your customer account and order processing  

 

We process your data in the course of ordering transactions on our marketplace to enable you to select and order the selected products and services, as well as their payment and delivery or execution.

The following data is collected and processed to ensure a provision of the contractual service in the context of the operation of the marketplace, billing, delivery. Furthermore, for the processing of customer inquiries and user complaints, for customer retention and improvement of our service:

3. Collection, processing and use of personal data for orders

 

When ordering, we collect and use your personal data only to the extent necessary for the fulfillment and processing of your order and to process your requests. The provision of the data is necessary for the conclusion of the contract. Failure to provide the data means that no contract can be concluded. The processing is based on Art. 6 (1) lit. b DSGVO and is necessary for the fulfillment of a contract with you. Your data will not be passed on to third parties without your express consent. The only exceptions to this are our service partners that we need to process the contractual relationship, or service providers that we use in the context of order processing. In addition to the recipients named in the respective clauses of this privacy policy, these are, for example, recipients of the following categories:  


Shipping service providers, payment service providers, merchandise management service providers, service providers for order processing, web hosting service providers, other IT service providers and shipping service providers. In all cases, we strictly observe the legal requirements. The scope of data transfer is limited to a minimum.  


4. Disclosure of personal data to our represented dealers and service providers 

 

In order to fulfill the contract, we also pass on your data to the sellers and service providers represented at buyhappy, insofar as this is necessary for the delivery of ordered goods. The following data is transmitted: E-mail address, postal address and ordered products. If the purchaser has provided further data in the context of his order (e.g. a different delivery address or a telephone number), these will also be transmitted. All sellers and service providers are contractually obliged to use the data only for the processing of the order and not for other purposes, in particular advertising. The seller and service provider shall process the aforementioned data electronically for the proper fulfillment of the contract, in particular for shipping, invoicing and posting of payments. For the purpose of shipping, the seller and service provider may also transmit the name and address of the customer to the contracted shipping company. The seller and service provider will keep the data stored until all mutual claims arising from the order have been fully settled and the commercial and tax retention obligations for the provider have expired. The customer may at any time request information free of charge from the seller and service provider about the data he has stored about the customer. Furthermore, the Customer may at any time request the correction of incorrect data. For data processed by the seller and service provider itself, the respective seller and service provider is responsible for data protection. 

 

Use of your e-mail address for sending newsletters  

 

We use your email address independently of the contract processing exclusively for our own advertising purposes for sending newsletters, provided that you have expressly consented to this. The processing is based on Art. 6 (1) lit. a DSGVO with your consent. You can revoke your consent at any time without affecting the legality of the processing carried out on the basis of the consent until revocation. You can unsubscribe from the newsletter at any time by using the corresponding link in the newsletter or by notifying us. Your e-mail address will then be removed from the distribution list.  


5. Passing on your e-mail address to shipping companies for information about the shipping status  

 

We pass on your e-mail address to the transport company within the framework of the contract processing, provided that you have expressly agreed to this in the order process. The purpose of the transfer is to inform you about the shipping status. The processing is based on Art. 6 (1) lit. a DSGVO with your consent. You can revoke your consent at any time by notifying us or the transport company, without affecting the legality of the processing carried out on the basis of the consent until the revocation.

We take appropriate technical and organizational measures to ensure a level of protection appropriate to the risk, in accordance with the law and taking into account the state of the art, the cost of implementation and the nature of the scope, circumstances and purposes of the processing, as well as the varying likelihood and severity of the risk to the rights and freedoms of natural persons.  


The measures include, in particular, ensuring the confidentiality, integrity and availability of your data by controlling physical access to the data, as well as access to, input, disclosure, security, availability and segregation of the data. Furthermore, we have established procedures to ensure the exercise of data subject rights, deletion of data and response to data compromise. Furthermore, we already take the protection of your personal data into account in the development and selection of hardware, software and processes, in accordance with the principle of data protection through technology design and through data protection-friendly default settings.  

 

 9. External payment service providers

The transmission of your data to Stripe is based on Art. 6 (1) a DSGVO (consent) and Art. 6 (1) b DSGVO (processing for the performance of a contract). The purpose of the transmission of the data is payment processing and fraud prevention. The personal data exchanged between Stripe and the controller may be transferred by Stripe to credit reporting agencies. The purpose of this transfer is to check identity and creditworthiness. Stripe may disclose the personal data to affiliated companies and service providers, or subcontractors, to the extent necessary to fulfill contractual obligations, or to process the data on behalf.  


You have the option to revoke your consent to data processing at any time. A revocation does not affect the validity of past data processing operations. All data required for payment processing will be used exclusively for the execution of payments and transmitted via the "SSL" procedure. Stripe is certified according to PCI DSS.

10. Merchants  

 

If you buy from a merchant via buyhappy, we transmit the data necessary for processing the order to this merchant. We never forward data about means of payment to the merchants. All merchants are contractually obligated to use the data only for the processing of the order and not for other purposes, in particular advertising.

15. Data Storage Period

 

After complete processing of the contract, the data will initially be stored for the duration of the warranty period, thereafter taking into account statutory, in particular tax and commercial law retention periods and then deleted after expiry of the period, unless you have consented to further processing and use.
